  1. The confidentiality of your personal data is one of the main concerns of the Centre for Protected Areas and Sustainable Development Bihor Association (hereinafter referred to as CAPDD Bihor Association), with headquarters in Oradea, Piața 1 Decembrie 6, 1st floor, room 8, postal code 410048, county of Bihor. Bihor, established by Civil Judgment no. 10 / 08.02.2002, with fiscal code 14571970, legally represented by President Paul Iacabaș, as data controller. The purpose of this document is to inform you about the processing of your personal data in the context of the use of the website www.padureacraiului.ro (“the Site”).

The website www.padureacraiului.ro was created within the project “Pădurea Craiului, a better place to visit, a better place to live” with the aim of informing visitors about the natural attractions, cultural attractions, events, services and activities that can be carried out in the only tourist eco-destination in Bihor county.

 

II. Categories of personal data processed

 

 

  1. If you are a user of the Site, CAPDD Bihor Association will process your personal data that you provide directly in the context of using the Site, such as the data (name, surname, e-mail address) that you provide in the contact section, to the extent that you choose to contact us in this way.
  2. In addition, the Site provides users with a registration form for the Newsletter section, through which they can subscribe to receive regular newsletters by email.

III. Purposes and grounds for processing

If you are a user/visitor of the Website, CAPDD Bihor Association processes your personal data as follows:

– for marketing activities, i.e. for the transmission, via remote communication means (e-mail) of communications in the form of a NEWSLETTER on news and various news related to the tourist eco-destination Pădurea Craiului.

You can express your consent to the processing of your data for this purpose by filling in the appropriate box in the newsletter subscription form available on the Site. To unsubscribe from receiving such communications you can use the option at the end of each email containing NEWSLETTER communications.

Providing your data for this purpose is voluntary. Refusal to provide your consent to the processing of your data for this purpose will have no negative consequences for you.

– for the purpose of communication within the contact section, to the extent that you choose to contact us in this way.

Grounds: The processing of your data for this purpose is based on your consent, if you choose to contact us by completing the contact form version made available to users on the Site.

Providing your data for this purpose is voluntary. Refusal to provide your consent to the processing of your data for this purpose will have no negative consequences for you. In this context, any message sent by the user may be retained for future reference.

– to resolve complaints, grievances and to monitor traffic and improve your experience on the Site.

Basis: The processing of your data for this purpose is based on the legitimate interest of CAPDD Bihor Association to ensure the proper functioning of the Site, as well as to continuously improve the experience of visitors to the Site, including by resolving various comments, questions or complaints.

Providing your data for this purpose is voluntary. Refusal to provide data for this purpose will have no negative consequences for you.

 

VII. Your rights

Under the conditions laid down in the legislation on the processing of personal data, as data subjects, you have the following rights:

– the right to information, i.e. the right to receive details of the processing activities carried out by the CAPDD Bihor Association, as described in this document;

– the right of access to data, i.e. the right to obtain confirmation from the CAPDD Bihor Association regarding the processing of personal data, as well as details of processing activities such as the way in which the data are processed, the purpose for which the processing is carried out, the recipients or categories of recipients of the data, etc.;

– the right to rectification, i.e. the right to have inaccurate/unjustified personal data corrected and incomplete data completed by the CAPDD Bihora Association without undue delay; the rectification/completion will be communicated to each recipient to whom the data were transmitted, unless this proves impossible or involves a disproportionate effort.

– the right to erasure of the data without undue delay (“right to be forgotten”) if one of the following grounds applies:

– they are no longer necessary for the purposes for which they were collected or processed;

– where consent is withdrawn and there is no other legal basis for the processing;

– if the data subject objects to the processing and there are no legitimate grounds for objecting to the processing;

– if the personal data have been unlawfully processed;

– if the personal data must be erased to comply with a legal obligation;

– personal data have been collected in connection with the provision of information society services in accordance with Union or national law governing the controller.

It is possible that, following the request for deletion of the data, the CAPDD Bihor Association may anonymise these data (thus depriving them of their personal nature) and continue processing for statistical purposes under these conditions;

– the right to restrict processing insofar as :

– the person disputes the accuracy of the data, for a period that allows us to verify the accuracy of the data;

– the processing is unlawful and the data subject objects to the erasure of the personal data and requests instead the restriction of their use;

– the controller no longer needs the personal data for the purpose of the processing, but the data subject requests it for the establishment, exercise or defence of legal claims; or

– the data subject has objected to the processing (other than for direct marketing purposes), for the period of time during which it is verified whether the legitimate rights of the controller prevail over those of the data subject.

– the right to data portability, i.e. (i) the right to receive personal data in a structured, commonly used and easily readable format, and (ii) the right to have such data transferred by the CAPDD Bihor Association to another data controller, provided that the conditions laid down by law are met;

– the right to object – in relation to processing activities may be exercised by submitting a request as indicated below;

– at any time, for reasons relating to the data subject’s particular situation, to have the data relating to him or her processed on the basis of the legitimate interest of the CAPDD Bihor Association or on the basis of the public interest, except where the CAPDD Bihor Association can demonstrate compelling legitimate grounds for processing which override the interests, rights and freedoms of data subjects, or where the purpose of the processing is to establish, exercise or defend a legal claim;

– at any time, free of charge and without any justification, that data relating to him or her be processed for direct marketing purposes.

– the right not to be subject to an automated individual decision, i.e. the right not to be subject to a decision taken solely on the basis of automated processing activities, including profiling, which produces legal effects concerning the data subject or otherwise significantly affects him or her;

– the right to address the National Supervisory Authority for the Processing of Personal Data or the competent courts, to the extent you consider it necessary.

VIII. The processing of personal data shall be carried out in accordance with the following principles:

1) The processing of personal data shall be carried out pursuant to and in accordance with the legal provisions and shall be fair and transparent.

2) Any processing and collection of personal data shall be for purposes that are well-defined, explicit and legitimate, adequate, relevant and not excessive in relation to the purpose for which they are collected and further processed.

3) Persons processing personal data on behalf of an institution shall have a confidentiality clause in their employment contract and job description.

4) In any processing of personal data, to be lawful, at least one of the following must apply: the data subject has given his or her express, free, unequivocal and informed consent to the processing; the processing is necessary for entering into or performing a contract; the processing is necessary for compliance with a legal obligation; the processing is necessary to protect the vital interests, the public interest of a controller or a third party.

5) Information to the data subject is made by the institution processing the personal data of the data subject.

6) Data subjects have the right of access to the data being processed, the right to intervene on them, the right to object and not to be subject to an individual decision, as well as the right to address the National Supervisory Authority for Personal Data Processing or the court to defend any rights guaranteed by law, which have been violated. Also, under the new GDPR, individuals have the right to portability of personal data, the right to restriction of personal data and the right to be erased or forgotten.

7) Personal data security measures are established by written procedures so as to ensure an adequate level of security of the personal data processed.

8) The CAPDD Bihor Association through the website www.padureacraiului.ro may collect personal data from its users, but only with their consent and if they provide it voluntarily.

In this case, the consent is considered to be expressly granted when filling in the registration form in the NEWSLETTER section with the e-mail address, respectively when filling in the “name” and “e-mail” fields in the case of sending the contact form.
